LICENSE AGREEMENT
IMPORTANT-READ CAREFULLY:
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Florent Pillet for the software accompanying this EULA, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT" or "SOFTWARE"). By exercising your rights to make, install, and use copies of the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. Unless you have a different license agreement signed by Florent Pillet your use of this software indicates your acceptance of this EULA.
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
REGISTERED VERSION
One registered copy of Outliner may be used by a single person who uses the software personally on one or more computers.
Once you have paid a registration fee and have entered registration data into Outliner, you are no longer using a Shareware Version but are still bound by other clauses in this Agreement.
SHAREWARE VERSION
Evaluation and Registration
This is not free software. Until you pay your registration fee, you can only create 2 outlines. Subject to the terms below, you are hereby licensed to use this software for evaluation purposes without charge for a period of 60 days. If you use this software after the 60th day evaluation period a registration fee of $19 is required. Payments must be in US dollars and should be sent Outliner/Florent Pillet, c/o Kagi Shareware, 1442-A Walnut Street #392-4Q, Berkeley, California, 94709-1405, USA. If mailed, an order form must accompany the payment. The "REGISTER" application that accompanies the software can be used to generate your order form. To order directly on the Internet, visit the URL of http://order.kagi.com/?4Q.
When payment is received you will receive a name and registration key by e-mail that you need to enter in the software (please see the manual for registration details).
Unregistered use of Outliner after the 60-day evaluation period is in violation of French and international copyright laws.
Distribution
Provided that you verify that you are distributing the Unregistered Shareware Version you are hereby licensed to make as many copies of the Shareware version of this software and documentation as you wish; give exact copies of the original Shareware version to anyone; and distribute the Shareware version of the software and documentation in its unmodified form via electronic means. There is no charge for any of the above. You MAY NOT DISTRIBUTE this program on any disk costing more than $5 without explicit written permission from Florent Pillet. You MAY NOT DISTRIBUTE this program on any CD without explicit written permission from Florent Pillet. You MAY NOT DISTRIBUTE this program on any Web Site, FTP Site, or other "download area" without explicit written permission from Florent Pillet. While we will do our best to accommodate such distribution requests, we suggest that you simply give out the URL of http://www.teaser.fr/~fpillet/pilot/outliner.html so that you are not in violation of this agreement.
You are specifically prohibited from charging, or requesting donations, for any such copies, however made; and from distributing the software and/or documentation with other products (commercial or otherwise).
LIMITATIONS
Limitations on Reverse Engineering, Decompilation, and Disassembly.
You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Separation of Components.
The SOFTWARE PRODUCT is licensed as a single product. Its component parts may not be separated for use on more than one computer device.
Software Transfer.
You may permanently transfer all of your rights under this EULA, provided the recipient agrees to the terms of this EULA.
Termination.
Without prejudice to any other rights, Florent Pillet may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
COPYRIGHT
All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by Florent Pillet or his suppliers. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material.
LIMITED WARRANTY
NO WARRANTIES.
Florent Pillet expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you. NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
In no event shall Florent Pillet or his suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this Florent Pillet product, even if Florent Pillet has been advised of the possibility of such damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
US GOVERNMENT RESTRICTED RIGHTS
The SOFTWARE and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as applicable. MISCELLANEOUS
If you acquired this product in the France, this EULA is governed by the laws of France. If this product was acquired outside France, then local laws may apply.
